Terms of Service

By commissioning me, you have understood and accepted the terms below.

1. COPYRIGHT / USAGE POLICY

THE ARTIST:
• I, Kai (the artist), retain all rights to the commissioned artworks, including but not limited to distribution, reproduction, self-promotion, uploading on social media sites, commission samples, etc.
• Commissioned artworks will include a subtle watermark.
• I might record the drawing process and post it on social media.
• I have the right to decline any commission request I do not feel comfortable drawing.
• Prices are subject to change based on demand.
• The Terms of Service are subject to change at any time. The updated terms will not apply retroactively and will have no bearing on commissions placed under previous terms.THE CLIENT:
• The commissioned artworks are strictly for personal use only.
• Uploading the commissioned artworks on social media must include credit to the artist.
• Do not distribute, reproduce, or profit from the commission in all forms. Personal prints are allowed.
• The client cannot claim the art as their own.
• For original characters, the client can claim the character(s) as their own but not the artwork itself.
• Using the commissioned piece on their YouTube channel and monetized videos are allowed as long as the artwork is not the main subject for the earnings.
• Using the commissioned piece in any blockchain technology, such as NFTs, is prohibited.
• Removing the watermark or altering the commissioned artwork is not allowed.
• Any usage related to artificial intelligence or AI is strongly prohibited. 🚫

2. PAYMENT

• Pay the commission through an invoice via PayPal in USD ($) currency or through Ko-fi by sending a donation. Please confirm the transaction/receipt if the payment is on-hold.
• Clients in the Philippines may opt to pay the commission via GCash or Maya in PHP (₱).
• Pay upfront (50% or 100%) after the sketch approval. The remaining 50% will follow after the final artwork.
• Failure to settle the full payment will lose all beforementioned rights to the commissioned piece, including sketches, drafts, and progress screenshots.
• No refund once I started working on the commission.

3. PROCESS

• Submit a commission form then contact me via email. (See info page)
• Please provide multiple visual references and detailed descriptions of the character(s). A pose reference is required. I will not accept a commission with insufficient references and unclear character descriptions.
• I am only able to handle one commission at a time to prevent myself from getting overwhelmed.
• First come, first served. I will work on commissions according to slot number/waitlist. You may opt to cancel your commission order while you are on the waitlist.
• Commissions may take 2 to 5 weeks to complete depending on the complexity and other factors that may affect my working condition. Expect some delays because I'm busy during weekdays.
• I will let you know if anything happens that will slow the commission's progress.
• A maximum of two major (2) revisions is allowed in the sketch and line art stage and one (1) major revision in coloring. If I make a mistake on my end, I will apply changes free of charge.
• While working on your commission, I might keep asking for feedback and reviews.
• I will send the finished commission in a full-resolution image (.PNG) file via email or Google Drive. It will not include the working file (.CSP or .PSD).
